Why do you need to register a name as a trademark?

There are several main reasons for this:

  1. Exclusive right to use in its class. Registration allows you to prohibit the use of identical and similar signs by others. The right holder may file claims for damages against infringers.
  2. If a trademark is not registered, other persons will be able to secretly register it in their own name and prohibit its use. In this case, they will be able to recover compensation.
  3. It is an excellent commercial asset. The company name in the status of a trademark can be used when receiving subsidies or investments. It can be sold, leased under a franchise (under a license agreement), pledged, put on the company's balance sheet, donated or inherited.
  4. The ability to resist counterfeiting. A trademark can be included in the customs register in order to block the importation of counterfeit products bearing the right holder's mark across the border.
  5. The owner has the right to prohibit the use of a domain name that is confusingly similar to its name, provided that the site contains commercial information that is homogeneous to the trademark owner's activities.
  6. Illegal use of warning markings (TM or R in a circle) in relation to an unregistered trademark is punishable by a fine of up to one hundred and twenty tax-free minimum incomes.
